According to Justice Viswanathan, Justice Gavai is an unafraid judge who expresses his opinions clearly.
Chief Justice of India (CJI) BR Gavai broke with precedent on Saturday by making a "touching gesture" in honor of retiring Judge Bela M. Trivedi, according to Supreme Court judge Justice KV Viswanathan.
Speaking at the Bar Council of India's (BCI) felicitation event in honor of the 52nd CJI, who was just appointed the nation's top judge, was Justice Viswanathan.
"I have to share with you some information regarding [his] administrative abilities, and I'll at least divulge one secret that I haven't asked his consent for. He was never swayed by protocol as a judge. But what we witnessed during our two days as Chief Justice is just amazing," he remarked.
According to CJI BR Gavai Justice Viswanathan, it is customary for judges at the highest court to gather at the portico of the judges' entry on their last day of service in order to bid the retiring judge farewell.
After the ceremonial sitting on the final day of the sitting, it often takes place at 1:30. The judges descend. He said, "The concerned judge also comes down from the chamber."
On Friday, though, Justice Viswanathan disclosed that this practice had changed.
However, we were all caught off guard yesterday when Justice Gavai chose to go up two floors to the chamber of Hon. Justice Bela Trivedi and enter her room directly from the Chief Justice's chamber on the ground floor. We did the same, welcoming her into the chamber before escorting her all the way down to the portico, where the learned judge is seated in the car and the car is symbolically pushed, along with a guard of honor.
According to Justice Viswanathan, it was a heartwarming gesture and a positive precedent. "I didn't disclose this without the Chief Justice's consent, but I figured you had to know since protocol didn't matter." Although it didn't matter, yesterday set a very positive precedent that will undoubtedly be followed in the future.
In response to Justice Gavai's ascent to the highest court in India, Justice Viswanathan stated,
His journey from Nagpur to Delhi and ultimately to the Chief Justice of India's highest position is very amazing. Many of the young people in the room and watching this program will be motivated by the fact that, according to our legal system, anything is possible with enough effort—that much has been demonstrated.

As you sit next to him, you sometimes get the impression that when he speaks, it comes naturally and without malice. Nothing goes beyond what he truly intends to say, and I believe it has had a telling effect—so much so that yesterday's message was also interpreted appropriately," he continued.

Speaking at the event, Solicitor General Tushar Mehta described CJI Gavai as grounded and "humility personified." He noted that Justice Gavai has made significant contributions to the development of jurisprudence and the administration of justice, although without much fanfare.
"A good judge is one who speaks less and lets his work speak," Mehta said.
Additionally, Mehta stated that Justice Gavai has assumed the role as a representation of the nation's average citizen to lead the judiciary.
He went on to say, "If we look at my Lord Justice Gavai's life journey, it can only be a part of a movie. From living in slums to holding the position of the highest judicial office in the country, it requires multiple qualities in one person, and it is rare to have multiple qualities in one person."
